The Get Growing, Get Going New York City Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY: OPEN ONLY TO AUTHORIZED AVON INDEPENDENT SALES REPRESENTATIVES WHO ARE LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, AND WHO ARE AT LEAST 18 YEARS OF AGE OR OLDER (“REPRESENTATIVES”). VOID WHERE PROHIBITED. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of The Avon Company (“Sponsor”), its parent, subsidiaries, affiliated companies and advertising and promotion agencies and fulfillment providers are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this sweepstakes. Sweepstakes is subject to all applicable federal, state and local laws.

SWEEPSTAKES PERIOD: The sweepstakes begins with the opening of Campaign 1, 2022 on December 8, 2021 and ends with the close of Campaign 1 on December 21, 2021 (“Sweepstakes Period”).

TO ENTER:

1) Recruitment Method of Entry: During the Sweepstakes Period, Representatives will automatically earn one entry when they convert a new or pending recruit to an active Representative who sells a combined value of $60 or more of Avon product cumulatively through all approved selling channels, including avon.com, avonnow.com, and any offline channels such as the Avon Sales Center, during the Sweepstakes Period (“Qualified Recruit”). Each Representative will earn one entry per Qualified Recruit. Limit ten (10) entries per Representative. Additional entries will be void. All qualifying sales activity for Qualified Recruits must be recorded by the close of Campaign 1, 2022.

2) Mail-In Method of Entry: To enter without meeting specific recruiting goals, hand-print your full name, Representative number, date of birth, street address (including city, state and zip code) and day and evening telephone numbers on a piece of paper or a 3”x5” index card and mail it in an envelope with proper postage affixed to: Get Growing, Get Going New York City Sweepstakes Entry, The Avon Company, One Liberty Plaza, New York, NY 10006. Mail-in entries must be postmarked during Sweepstakes Period, no later than December 21, 2021, and received by January 3, 2022. Limit one (1) mail-in entry per stamped, outer envelope. Each mail-in entry equals one (1) Sweepstakes entry.

There is a maximum limit of ten (10) entries per Representative, regardless of method of entry. Entries in excess of this limitation will be void. Entries generated by script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Sponsor and will not be acknowledged. Sponsor reserves the right to audit all sales data when determining Qualified Recruit eligibility and reserves the right to disqualify or remove any Representative it determines has violated principles of fairness or program intent, or any violation of the Business Policies and Procedures for Avon Independent Sales Representatives or the Independent Sales Representative Contract Terms and Conditions. Sponsor will monitor for returns, and has the right to disqualify or charge back for the full value of the prize, if it determines that a disproportionate number of units were returned.

DRAWINGS: Potential winners will be selected in a random drawing on or about January 4, 2022 from all eligible entries received. Odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION: Potential winners will be notified by email and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, a potential winner is not in compliance with these rules, or Sponsor is unable to contact the potential winner within a reasonable time period, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected. If a potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. The person selected by the winner as his/her intended travel companion must be 18 or older and must also sign and return a travel release within the same time period as provided above for the potential winner to execute and return.

PRIZES (2): Each winner will receive a three (3) day / two (2) night trip to New York, New York for winner and one (1) guest. Winner and guest will travel on Sponsor-selected dates expected to take place between January 17, 2022 and April 30, 2022. Prize includes: roundtrip coach class transportation for winner and guest from a major U.S. gateway airport in the 50 United States and D.C. nearest winner’s residence to New York, NY; two (2) nights’ standard hotel accommodations (one room, double occupancy) at the Millennium Hilton New York Downtown Hotel, or a hotel of Sponsor’s choice; airport/hotel ground transfers; $400 meal allotment; a tour of The Avon Company offices in New York City, tickets to a Broadway Show, valued at $100 per person and ground transportation to and from the Millennium Hilton Hotel. Approximate Retail Value (“ARV”): $2,000. Total ARV of all prizes: $4,000.

PRIZE RESTRICTIONS: Actual value of prize may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes cannot be redeemed for cash. Winner may not substitute, assign or transfer a prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) of comparable or greater value. Winner and guest must travel together and will be responsible for all necessary travel documents. Travel must be made through Sponsor’s agent and on a carrier of Sponsor’s choice. Winner will receive $400 to spend on meals for winner and guest during the trip in the form of a pre-paid card. Prize does not include additional unspecified ground transportation. Sponsor is not responsible for changes to schedule or cancellation by airline, the Millennium Hilton Hotel or any other vendor associated with prize acceptance and use. In the event that the prize winner is able to participate in the prize as scheduled, but the visit to The Avon Company New York offices or Broadway show does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, location changes, an event of force majeure, or for any other reason, Sponsor will have no further obligation to the winner. Winners are responsible for all federal, state and local taxes as well as any other costs and expenses associated with prize acceptance and use. Winner and guest must abide by any and all rules and regulations required by any vendors associated with use of prize, including but not limited to any COVID-19 restrictions and requirements by airlines, hotels, transport companies, and venues and any COVID-19 guidelines or requirements imposed by Avon or federal, state and local governments. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person/mailing address/household for any and all sweepstakes in the Get Growing, Get Going Sweepstakes series.

PUBLICITY GRANT: By entering, you give Sponsor and its designees the right to use the content associated with your Sweepstakes entry, including but not limited to your name, city and state of residence, information regarding any prize you may win in the Sweepstakes, if any, performance statistics and other information relating to your Avon business including recognition of any sales, recruiting or motivation success you achieve, and your voice, photographic, video, and/or other image and other likenesses of you that is: (a) submitted with your entry; or (b) filmed or photographed by the Sponsor during the course of the Sweepstakes, (referred to hereafter collectively as the “Entry Content”) for advertising, trade and promotional purposes (including, but not limited to, announcing winner’s name on the Avon page on Facebook or via Avon’s other social media accounts) without further compensation to you, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without further notice to you, and without your further review, or approval.

Specifically, you: (a) irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual right to use, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit, and otherwise use the Entry Content in connection with the Sweepstakes and all promotions of the Sweepstakes and/or Avon in any paid or unpaid media throughout the world, without additional review, compensation, or approval from you or any other party, at Sponsor’s sole discretion; (b) forever waive any claims that use of the Entry Content, as described in these Official Rules violates any copyrights, trademark rights, privacy rights, publicity rights, or any other legal or moral rights that you or others claim to own, and any claims that Sponsor is otherwise precluded from using the Entry Contents in connection with the Sweepstakes, including but not limited to the promotion and advertising of the Sweepstakes and/or Avon.

LIMITATIONS OF LIABILITY: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, referral, links or emails; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the sweepstakes, the malfunction of any unique referral link, the processing of entries, the announcement of the prizes, or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes (or any portion thereof) should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries. If terminated, Sponsor may, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants, by participating, agree that Sponsor and its respective parents, subsidiaries, divisions, affiliated companies, advertising and promotion agencies and fulfillment providers, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this sweepstakes. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

WINNERS LIST: The winners’ list may be obtained after February 14, 2022 by sending a hand-printed, self-addressed, stamped envelope to: Get Growing, Get Going New York City Sweepstakes, c/o The Avon Company, 165 Broadway, New York NY 10006, for receipt by March 14, 2022.
